He is Not on the brake , that is spray from the right side. Brake water goes straight up not out low.

Yes I don't think he has a brake on the boat I don't see another peddle on it. Although how the spray comes off of the brake depends on how its set up, some shoot back at an angle and some shoot up between the rudders.
