Alachua County Commision meeting

Tuesday June 14, 2005 the Alachua County Commision is meeting to discuss planned restrictions on Airboats and other water craft on all area lakes. The main topic is followup on meetings held in 2002.

It's not looking good for airboaters in this area. They are discussing hours of operation, mufflers, no wake zones, no motor zones, either seasonal or permanent. This applies especially to Water Melon Pond, it is going to be a no motor lake soon.

It doesn't help that the sheriff has just built a new house on Orange next to park in Cross Creek.

I don't know what we can do to head it off but a large crowd at the meeting would help a lot. I'll try to find out more later.

what time is the meeting ? where is it located ? do you have names and mailing address of commitioners e-mail and phone numbers ? those of us that cant make it can still voice our opinion

June 14th at 9:00am in the County Administration Building, Rm 209, 12 SE first St. Gainesville, Fl.

This is a serious matter going before the board of County Commissioners in Alachua County. Not only do they have a strong organized body of anti-airboaters pushing them to pass stronger airboat restrictions and in some lakes pushing to eliminate airboats altogether but they also have the support of the County Sheriff who has recently moved to Orange Lake and decided that he does not like the airboat noise. The best that I can tell is that the anti-airboaters have already accomplished a lot with the County Commissioners and are now aggressively moving forward with the help of some $105,000 in grant money received through the Florida Wildlife Conservation Commission.

If you try to find this topic on the County Commissioners Agenda for the June 14th 2005 meeting, You wont! This is how items are allowed to sneak by without any of us even knowing. The item was placed on the agenda late in the day on 6/8/05 By Robert Avery who, from best I can tell is from the Public Works Dept.

This is how his Agenda Item Summary reads:

Executive Summary: On March 22 2005, The Board approved a $105,000 Florida Boating Improvement Program (FBIP) grant administered by the Florida Wildlife Conservation Commission (FWCC). The grant funds will be used to hire a consultant to assist in the preparation of a Countywide Recreational Water Use Master Plan. The Consultant will be selected through the County's Request for Proposal (RFP) process. The Board directed that they first review and approve the RFP Scope-Of-Services. Their recommended changes have been included in the current scope-of-services.

(NOW THIS IS THE PART THAT BOTHERS ME, BECAUSE IT SEEMS THAT ALL OF THIS IS DERIVED FROM ONE INCIDENT AND A COUPLE OF COMPLAINTS)

Background: In July, 2000, The County Manager formed the Water Use Zoning Team as part of the County Commission's Strategic Plan, Tier 2, Quality of Life Objective. The Team was formed in response to the swamping of a canoe in Lake Alto Canal and to a pattern of water body related complaints stemming from airboats on Orange Lake, ongoing incidents at Watermelon Pond and concerns about Santa Fe Lake. Excessive boat speeds on water bodies in Alachua County and other concerns related to safety, noise and environmental impacts have prompted past discussions by the County Commission and County Staff on the use of boat exclusion and no-wake zones but additional work was needed to review issues of effectiveness, enforceability and cost.

The objective of the team was to developed a water use zoning plan to promote safety, reduce noise, and protect environmental resources on water bodies in Alachua County. The team included county staff from the Environmental Protection Department, Planning & Development, Codes Enforcement, Public Works, Fire and Rescue and the County's Attorney's Office. Other agencies represented included the Alachua County Sheriffs Office, The Florida Fish & Wildlife Conservation Commission and the Suwannee River Management District. Citizens on the team represented the Santa Fe Lake Dwellers Association, Orange Lake and Watermelon Pond. The team reviewed state laws, permitting requirements, previous actions, and County codes for applicability and effectiveness. The team also researched safety issues, noise and environmental impacts.

On October 22, 2002 the Board heard a presentation of the Water Use Zoning Team Report. A recommendation of the report was to apply for a Florida Wildlife Conservation Commission Florida Boating Improvement Program grant. On March 22, 2005 the Board approved a FWCC-FIBIP $105,000 grant for the preparation of the Countywide Recreational Water Use Master Plan. The Board needs to approve the Scope-of-Services for a request for Proposal (RFP) that will be advertised to select a consultant for the preparation of the Countywide Recreational Water Use Master Plan.

Alternative 1: Recommend changes to the Scope-of Services

To my knowledge there seems to be no opposition to this with the County Commissioners and unless they receive opposition at the June 14th 2005 meeting it will most likely be passed by the board.
I have not been able to get a copy of the Countywide Recreational Water Use Master Plan, but I'm working on it. Also I want to find out who has authored all of these proposals that have easily passed through the Board. If one county puts something like this in place, you can mark my words that other counties will follow and we will surely loose a lot of water use rights. Letters need to start being sent to these County Commissioners even if it is to ask for clarification on this topic. They need to see that there is another side to this issue because up till now they have not heard from the airboaters or anyone showing any opposition to this Master Plan they want to put into play. I had a real hard time getting what little bit of information I was able to get. If you will notice the County Manager is who formed the Water Use Zoning Team as part of the County Commission's Strategic Plan, Tier 2, Quality of Life Objective. That has to send a red flag up right there. I hope we are not too late on this one. I would like to see as many airboaters as we had in Citrus show up here. Any help is appreciated. Terri
 
I have a copy of the Water Use Zoning Team Preliminary Report. It was presented to the Alachua County Commision on August 27, 2002.
I can't put the entire report on the web, but will repeat the recommendations that pertain to Orange Lake:

Properly establish and enforce the no-wake zone in Cross Creek.
Enforce airboat muffler law.
Allow open water operation operations only.
Establish and enforce a curfew of 10 PM to 7 AM.
Establish a no-wake zone for all water craft within 150 to 500 feet of all docks, ramps, shorelines, tree lines, etc, due to safety hazards.

This porposal was not implemented because of legal situations pertaining to sign placement, current zoning problems, and other situations.
The county lawyer suggested that the whole thing be shelved until a grant could be located to fund a consultant.

The consultant was then to be hired with the charge of laying out a program that would allow legal implementation of all the current and future restrictions.

One other note: I did not attend the meeting yeaterday, but did catch it on television. Several airboaters tried to confront, and dispute the commision, and even to interrupt speakers. This just pisses them off and makes them more likely to do away with airboats.

Believe what the sheriff said at the end of the meeting. By July 4, 2006 Alachua County will be a much quieter place.
Don't forget, when you ride on Orange, or Right Arm, you are in the Sheriff's back yard.
 
That lake has just become a private lake for the Sheriff and everybody who lives on it. We need to schedule a monthly ride there shortly before we can’t ride there anymore. What was the conclusion of the meeting more meetings or did they come up with some new regulations? I think the time has come for all air boaters in all counties to start a club with dues like the NRA so we can fund some bad ass lawyer’s to represent air boaters and defeat these people who move onto the water and try to make the water their own private area. I can’t believe the airboat manufactures are not already out there working together. The airboat owners and manufactures had better start soon. Especially the manufactures since it’s your lively hood. There is a great group gaining power that has really been doing some good they even have backed politicians that represent boaters and have been legally fighting this type of crap their called Citizens for Florida’s Waterways they only charge $25 for membership and you get a news letter that informs you of proposed boating restrictions and who is pushing against or for our boating rights. They have several sponsors and are doing a great job the number is 321-722-4137. They have actually been getting some of our boating rights back on the intercostals. Hell I know allot of air boaters would contribute to a rights protection program. Come on guy’s let’s start something.

I think the commission feels they could go ahead and stop the airboaters right now. What they want is a master plan for all the waterways in the county.
No one has mentioned the guy that spoke yesterday about lake Sante Fe and all the jet skis and speed boats.
I really don't think they will stop until they eliminate all motor powered boats.

I'd really like to know who the name of the consultant they have just hired. Anybody know?
 
They have not hired a consultant yet. This is where we have to get busy.
The money they are wanting to use to hire this consultant is coming from grant money provided by FWC. I have looked over the quidelines for the use of this money and hiring a consultant does not fall into the quidelines. This grant money is suppose to be used for implementing and repairing boating access facilities. I am sure that the group who submitted this grant application did not specify to FWC that this money would be used to pay a consultant or I am sure the FWC would not have approved it. We have got to make some phone calls to FWC about this and put the pressure on them to make sure this money is used within the quidelines of the grant. FWC recieves this grant money from portions of the fuel tax.

On another note, the Alachua County Sheriff, (Sheriff Oelrich) has recently moved to Orange Lake and decided that he does not like airboat noise, he is doing everything within his power to get them off the lakes. He is holding his own little demonstration of airboat noise by bringing 2 county airboats to down town G'ville to give an example of what kind of noise they produce and to show that they do not stay in the 90Db range. This is ridiculous, the noise that will be produced by these airboats sitting on trailers, in a parking lot in down town G'ville is going to cause a disturbance and he knows it, let alone the fact that it will not even remotely relate to the sound an airboat makes when it is out on a rural lake not surrounded by buildings or on concrete. I feel he has over stepped his bounderies here. He is using his position to try and sway the opinion of the County Commissioners and the general public. I wonder what they will say if we show up with a chainsaw, a lawn mower, a Harley, etc to give examples of other things that exceed the 90Db level. I would like to ask everyone to send him a letter and let him know that he is out of line on this issue. the email address to send a letter or comment to is egainey@alachuasheriff.org Also ask him the date and time that he plans to do this, because I keep asking, but they tell me they don't know yet. I bet they try to slip it by, without anyone knowing. We need everyones support on this

My wife and I were in attendance at the recent Alachua County
Commissioner's meeting on June 14th 2005 in Gainesville, Florida.
As
you are aware there are some issues at hand right now in Alachua
County that directly effect airboaters.

At this meeting you informed the Commissioners and those in
attendance that next week you would be bringing two commercial
airboats, which are used by the county to down town Gainesville, more
specifically, the County Government Complex Parking Lot to
demonstrate the sound that is produced by airboats. My wife and I
were both appalled by this comment.

First off you have made it very clear to the general public that as a
resident of the Orange Lake area you find the sound generated by
airboats to be both annoying and troublesome.
But what bothers us most about this matter is that you will pull
county staff members, which we assume would be at the expense of the
county tax payer to conduct such a demonstration, which you are
neither versed in nor qualified to do.

Furthermore, the airboats that would be used to conduct this
demonstration do not represent the type of airboat that is used by
the average recreational airboater or commercial Frogger for that
matter in the state of Florida. When conducting any type of sound
generated testing or demonstration many variables have to be taken
into consideration. A large commercial airboat parked on a boat
trailer on an asphalt covered parking lot in the middle of a large
business district would not demonstrate an accurate level of sound
which is normally produced by an airboat driven on the rural area
lakes and rivers of Florida

Over the past year the Airboat Community and the Florida Wildlife
Commission has spent thousands of dollars and man-hours conducting
test on the sound that is generated by an airboat. The Florida
Wildlife Commission has contracted with Florida Atlantic University
to conduct such test that will give the FWC and the airboating
community scientific data to work with on this matter. At this same
meeting your County Commissioners were presented with a copy of the
documentation that has been conducted thus far by Florida Atlantic
University.

We cannot help but feel that this demonstration is emotionally
motivated by you and that you are using your position in the county
to try and sway the opinion of the general public. As airboaters we
would have no alternative if such demonstration were to take place
but to seek relief from the county for the adverse effect that this
demonstration would have on the airboat industry across the state of
Florida.

We are asking that you reconsider holding this demonstration and that
if you plan to hold any type of demonstrations, testing,
presentations etc in the future, that you would be considerate enough
to invite the airboating community and that such an affair would be
conducted without malice or bias and by qualified individuals in this
field.
