Ruling in a lawsuit brought by Americans United for Separation of Church and State and the state branch of the American Civil Liberties Union, U.S. District Judge Robert G. James said June 14 that the measure ran afoul of the separation of church and state.

In a seven-page decision, James observed, "This statute cannot help but create the appearance that the state of Louisiana is endorsing religion since the state has created a venue for public prayer (the quintessential religious practice) in public facilities under the supervision of public officials. The Court therefore finds that the statute is an unconstitutional governmental endorsement of religion."
 
Seperation of church and state was meant to protect the church from the state. Not to protect the state from the church.

These types of activist judges are distgusting to me.

This latest boating judgment is just another attempt to legislate from the bench.

Well guys, we as the people of this country need to take the power back. Passivism has given us what we have now. Until the people of this country stand up and kick a little A$$ to show them liberal panty wastes what this country was meant to be were just gonna keep sliding down hill.

Politicaly correct; what does that mean? I tell you what I think, laws are part of the political process so if you break them you suffer the penalty. Oh, I forgot though our goverment officials are better than us so the laws don't apply to them only us.

Sounds like that judge needs to step down, hell he's probably 100 years old. Thats another problem, their terms should be limited just like the President. That would insure that we wouldn't have a geriatric, waterheaded retard enturpriting our laws long after his sanity has left him.

If I were only President, boy the changes I would make. They would probably have me taken out in the first week. :D
 
At a time when the government is demanding more authority and power we must,and I mean MUST, begin taking power and authortiy away from them. The government must be subservient to us not in control of us. We seriously need to limit their finances as well.

The constitution pretty much sets the limits on the government, but for 200 years now the government has been trying to get more power, piece by piece. Now they are just short of dictating how things will be. This must be turned around. The gov should be on ite knees before the citizens and shoud have to beg for funds from the citizens for projects. If we keep em broke, they cant hurt us too badly.

This judge sure isnt doing himself any service. Certainly isnt doing anything good for the country, state or county. Likely catering to some small special interest.

Ducks Unlimited & Delta Waterfowl has been following this case for several years.

Many affluent hunting & fishing lodges don't want people in their backwater during the flood stages, which occur mainly in the winter months.

This all began several years back when they began arresting duck hunters along the MS for their decoy weights resting on the bottom of the flooded land.

Now it's the fishermen.

It's a real double edged sword for the law makers all up & down the MS Flyway.

Many know what the right thing to do is, side with the prevailing rights of the citizens back to the 1812 proclumation.

Many are also members of these affluent duck clubs, so here arises the "conflict of interest."

This issue is expected to go all the way to the Supreme Court for a final ruling, which if they stick to the law, the high water mark will be considered "navigable waters."

BTW, the same ugly issue raised its head locally last year between a developer & SJRWMD in regards to the NE corner of Lake Poinsett.
