TALLAHASSEE -- A bill permitting the use of deadly force during a home invasion or when an individual considers themselves threatened unanimously passed the Florida Senate on Wednesday.
 
its truly a shame that this is something that had to be voted on...
threaten me? in my home? only thing you can be sure of is death.

Isn't it a pity that before wed. you had to think about if your life is really in danger before you can react? Out here where I'm from ( Lake Jesup, Florida ) If someone has the guts to drive up my drive way, they are looking for one of two things. Either they belong there, or they are looking to cause trouble. If someone breaks into my house, the last thing they will hear is the sound of my 12 ga. chucking in a round of 1oz slug.
 
Thats great , one good thing . If someone trying to harm my family . I wonder if the 90db@50 ft Rule s apply to this . :lol:
 
Damn, in Louisiana not only can you pop a cap in someones azz if they are breaking into your home but you can also fill um full of lead if they try car jacking you.

FLORIDA SB-436/Castle Doctrine
BACKGROUND: SB-436 corrects a serious problem for citizens who chose to protect themselves in the face of attack by violent criminals. This bill REMOVES the "duty to retreat" in the face of attack; it creates the presumption that an attacker or intruder intends to do great bodily harm and therefore force, including deadly force, may be used to protect yourself, your family and others in the face of attack; it prohibits prosecution for defending that which you have a right to defend and prohibits civil lawsuits by criminals or relatives of criminals when criminals are injured or killed while attacking law-abiding people. The Courts in Florida have clearly eroded the rights of law-abiding citizens by imposing a "duty to retreat" (leave your property and RUN) when attacked. Law-abiding citizens should not be victimized by the state/courts for failing to retreat (RUN) from their own property or any place they have a right to be in the face of attack by an unlawful intruder. Nor should they be victimized for using deadly force against a perpetrator who unlawfully intrudes -- regardless of whether the victim knows what kind of force the perpetrator intends to use. Any victim should be able to presume that an unlawful intruder is there for the purpose of doing great bodily, and subsequently places the victim and the victim's family in great imminent peril. The Castle Doctrine is an ancient common law doctrine with origins going back at least to Roman law that provides that a man's home is his castle and, hence he may use all manner of force including deadly force to protect it and its inhabitants from attack. The Florida Constitution Article I, Section 2 guarantees basic rights to all natural persons including the right to defend life and protect property. The citizens of Florida have a right to expect absolute safety within their own homes or vehicles and to be able to use all manner of force against and unlawful intruder/attacker.
 
Nobody said y'all could not shoot em before. Just that if y'all did shoot em they could take your ass to court and sue for any damages!!!!! And WIN.
 
I seem to remember a few years ago, a burgalar broke into someones house, and was shot by the home owner. Unfortunatley, the SOB didn't die, but was rendered a crippled crook. That low life then took the homeowner to court and won a lawsuit for a very large amount. He claimed he now has no way of supporting himself. I guess there isn't too many hot spots to rob that have wheel chair ramps in front of 'em. The moral is, If you are going to shoot the bad guys, make sure they are dead. I suggest reloading at least twice, just to be on the safe side.
 
the last post was me,I forgot to sign in. But do ya'll agree with me or what? It seems that the criminals have more rights than the victims.
 
the problem is....that its hard to claim self defense, with more than say, 12
rounds in a 'criminal'.......how about 2 or 3 where it counts?

just remember not to ever shoot anybody in the back...not even a criminal.... unless of course you have to protect the family cat or hampster or something like that..
 
This new law is a great thing, and Bigbooms post sure helps make it cear for everyone.

We should all remember that any defensive gun use will have an aftermath that could be tough to live through, if it ever ends.

Be prepared to do it right, but hope you never have to kill any invading scum. The Government won't be there in those critical seconds to protect you.

Like others mentioned above, they will try to burn you because you did not run, had hyper leathal self loaded cartridges, did not aim for an arm or leg, or caused a 45 acp sized hole to appear where the laser dot once was.

I hope that I never am forced to, but I'll shoot to kill if I have to.
Then I'll have to decide about calling the cops, or loading the stinking carcass into the boat.

This new law is just good common sense, and is all about trying to stop punishing the victims. I'm glad I live in Florida where we have right to carry, and other strong second amendment protections that residents of other states do not.
 
Reminds me of a article/commentary I read about the recent situation with the Italian Journalist in Iraq-
