Judge lets aviation ordinance fly
He denies an appeal from an Arlington man whose hobby is planes.

Local aviation enthusiasts received bad news when a Duval County judge upheld a city ordinance that bans anyone from tinkering on airplanes and airboats at their homes and requires the craft to be stored in enclosed garages.
The ordinance, passed this summer, targeted Brian Kraut of Arlington, whose neighbors complained when he worked on his Midget Mustang airplane.

City Councilman Lake Ray sponsored the bill.

Kraut, who had successfully fought past citations related to his hobby, challenged the law as unconstitutional.

Judge John Moran didn't agree. He sided with Assistant General Counsel Jason Teal, who argued the case for the city.

While Kraut and other aircraft enthusiasts "may disagree with the city's decision to regulate aircraft on residential property, that does not mean that the decision was arbitrary and capricious," Moran said in the ruling. He said "cities have the right to zone based on aesthetic (or noise) considerations."

Jeffrey Ludwig, Kraut's attorney, said he planned to file a motion asking for clarification. He said the judge didn't clarify how working on an airplane is different from common hobbies such as working on a car in a garage.

"This is one more indication of just how unfriendly City Council has become to aviation and aviation interests in Jacksonville," he said.

Yeah who would want to live in duval county anyways ... they would never pass a law like that to cover anywhere else. Duval county is the largest county(population wise) in the state anyways I believe. So I urge all airplane and airboat folks to just move out of that county ... cmon down to more friendly places like polk county or highlands county or the friendliest of all probably would be glades county which has an ebtire tax base valued below donald trumps house over on the east coat. SO JUST MOVE OUTTA THERE.

This was only a joke, but seriously how did airboats get included with airplanes anyways. The law isn't a joke just my reply.
 
Talk about being singled out. I wonder if it is ok to work on or run a motorcycle, jet boat, kicker boat, street rod, lawn mower,all of which are just as loud in duval county.
 
I have an idea that the defendant in this case had already pissed somebody off.
I live in a small waterfront subdivision in Clay Co., just South of Duval.

I will occasionally start my boat and run it, but I don't do it at 2am, and I don't blow leaves into my neighbors yards either.
A little consideration for other folks can go a long way.
