MANATEE COUNTY ORDINACES

Well just for fun I pulled up the ordinances here and typed in AIRBOAT and heres what I got,

NOISE: no person shall operate or give permission for the operation of any vessel on county waters, including the intracoastal waterway, in such a manner as to exceed the following sound levels ata distance of 50' from the vessel: for all vessels, a maximum of sound level of 90 db

any person who refuses to submit to a sound level test when requested to do so by a law enforcement officer is guilty of a misdemeanor of the second degree, punishiable as provided in blah blah blah

a cited owner or operator may at his or her own expense, arrange for a sound level test to be conducted with the engine running at full throttle, by a private certified operator, in order to disprove the allegation that the engine is not reasonably muffled. if the sound level is below the maximum permissible level of 90 db at 50' the owner or operator shall not be guilty of a noncriminal infraction pursuant to sectio 2-32-23(b) hereof.

HOWS THAT FOR A SOUND ORDINANCE IT WAS APPROVED 11-30-99

NOW ABOUT AIRBOATS ;

1.) no person shall operate an airboat on any county waters between the hours of 600 pm and 800 am, eastern time.

2.) no person shall operate an airboat at any time on county waters in sarasota bay, south of cortez bridge, in palmasola bay, in perico bayou, in anna maria sound north of sr 64, in terra cia bay, in miguel bay or in bishop harbor.

3.) the above phrohibitions and restrictions do not apply to airboats owned or under contract to federal, state or local government and operated for official business by duly authorized personnel.

and just so you know ...

COUNTY WATERS; mean all public water, rivers creeks bayous, canals and channels, whether natural or man made, located in manatee county, including lake manatee, small inland lakes and all public waters within the jurisdiction of the county in which the tide ebbs and flows. the term does not include waters within the florida intracoastal waterway.

AIRBOAT: means a vessel which has a principle propulsion system which utilizes a pusher type or tractor type propeller, fan or blade which is not normally submerged below the water surface upon which the vessel operates; the fact an airboat can be propelled by a small auxillary motor or by some other force does not change its characterization as an airbaot.

there is more but I believe ya'll get the drift of it they dont like airboats over here !!!

so be warned it can happen to ya'll also.

Ane to think that Manatee county was one of my planned launches with the new boat this year!! What was I thinking?!!

Mother in law lives there so I guess that's reason enough to bypass!!LOL!!

Do you know of anyone in the county that has been ticketed?

Nope nobody runs over here anymore when someone is stupis enough to they bust them with the noise ordinance and as you read it is up to the cited owner to prove them wrong at the owners expense.

this can happen in citrus county just as easily as it did here. It all started over an airboat tour in perico bayou and after the net ban the fisherman resorted to airboats to chase mullet with cast nets and the yankees got pissed and this is the result.

funny thing about the noise ord. it doesnt say they have to use a sound meter it says you have to have it tested after they cite you or pay the fine all at your expense. so if you get a deputy who doesnt like you he just writes you up and you get to spend money no matter what with no recourse. sounds fair huh and people wonder why there are outlaws.
 
For manatee county ord 99-67 fwc - does not enforce . County only , Bishops harbor is a state preserve ! County cant enforce state waters let the law work for us for once , fwc is for us here thanks - just alitte sun shine some where

How large an area is Bishops harbor? Is there campsites anywhere there? (Or should I ask if the FWC allows overnight camping of any sort)!

Bishop's Harbor is a saltwater estuary that is pretty small. No state campgrounds but plenty of Skeeters and NoSeeUms. There are a couple of high ground lumps near where BH opens into Tampa Bay.
 
jeff go to http://www.dep.state.fl .us/coastal/downloads/maps/default.htm - to Terra ceia aquatic preserve . It will show you the area - camping is any where , you want Alot of sites few good ones , remember is on the bay. Stay close to shore . the sky way always in site .Alot of people will say no good - but i do all places! I live 3 min from there good luck . I hope i could help . Good people here! Just dont ask the deputies !
