Sold my little deck over 11ft' boat on ebay, delivered it, guy had it this week end. first time boat. told him front of hull needed silicone but not a problem, auto bilge worked fine. in the ad i said i guaranteed the boat 30 days if it was not what i said it was.
He left it in the water tied to a dock and sunk it. got it out , says it's ok but wants his money back and is cancelling his check.
he says the center weld on the bottom is "worn" through and cannot be welded; too thin.
1. I had to pump the hull out, it was FULL of rain water. now, if it was holding water sitting on the trailer, then how was it leaking and
2. he said the welds were "worn". too thin to re-weld; This boat wont run at all on any ground do to the power limits.

I am honest and want to do the right thing, things are just not adding up.

I'd get it back clean it up make sure it is structurally and mechanically sound and sell it to someone else, no warranty I don't warranty a boat I sell neither does anyone else that is privately selling a boat because you never what they are going to do with it, I been down that road anyone who is buying a boat (that has had any experience ) understands that. I had a guy buy a boat from me and take it out not knowing how to run a boat and hit a steel fence post and tore a 10" flap open in the polymer which caused him to lose control and total out the boat and said I sold it to him with polymer in that condition. But I later found out from the 4 people he had on the boat other him (thats right 5 people on a boat set up for 2 with an inexperienced driver) that he had hit a steel post sticking up about 4 inches in the water before the accident. And there was a large gouge in the aluminum on the bottom where the polymer was missing....imagine that. Take it as lesson learned and sell it to someone with some sense.
 
Wild Hair, this is just my opinion but it sounds to me like this guy has taken advantage of your good nature. He probably drove the boat, decided it wasn't exactly what he wanted, and now he wants out.

When I sell something I'm always very careful to point out anything that I think a buyer needs to know, just like you did with the silicone, but beyond that I think you need to sell something 'as is, where is' and not try to offer a warranty.
If he had kept the boat for 2 weeks and blown up the engine on it, he'd be back for that too. Even though it wasn't your fault, you'd be sitting with a boat with a blown engine you could no longer sell.

Being an honest trader doesn't require you to warranty something. As long as you're straight up with the buyer about anything you know of at the time of sale that might need to be repaired, I think that's enough.
 
Wild Hair Olf is right sound like he just wanted a ride for the weekend the person I bought my boat said it good to gate of his yard I am pleased with what I got made the changes on that I wanted keep on getting up.
 
If you were strait up with the buyer and he was negligent, I would just let the check clear and leave it to him to cancel the check. Assuming you deposited the check within an hour of the time you were given it, hes way too late to cancel. Checks actually clear in about 1-2 seconds these days. I'd say its his boat. End of story. There are some laws in Florida about people who buy things and then cancel the check. This dude needs to be vary careful in his accusations or he could end up in serious trouble.

If you made no representation as to he welds, then it is not an issue. In your post you guaranteed it to be what you said it is. Further his statement about something to be too thin to weld, just plain don't hold water, anyway. Doesnt matter if its true or not about the wear. Aluminum foil can be welded.

Everybody here has given ya good advice. If its a good boat you won't have any trouble selling it agian, just relist it on e-bay or boat trader. Even if its not a good boat and you are strait about what it is, theres a buyer out there.

I'd take the boat back and resell it without a warranty and I'd also take the time to put some silicone in the leak . I have sold boats with warranty's and with out even tried to buy a couple back after the new owners went to whinin.
Just wonderin, was the ole boy that bought your boat from Georgia .

E-bay is pretty harsh on people who cancel checks too. They will ban the man in a heartbeat. Further you should leave negative feedback for him as a buyer. Nobody else will sell to him then.

I "think" Florida law gives him like 24 hours to change his mind I think. Might check that out for factuality though. Buying at auction MAY negate the buyers remorse clauses anyway. I'm not sure you can warrant anything being sold at auction. I think all auctions are as is where is. Bears checking into for the facts though.

Fatboy is right on ! Never let him take the product til the checks clear, ask for certified check or money order, that eliminates the clearing time.

The checks have cleared....at least that is what my bank balance says.
Two things that bother me is 1. he sunk his / my boat but he thinks it is alright now and 2.the first words out of his mouth today was "i'm stopping payment on those checks"

when i offered to have a welder weld the seams he immediately said it could not be welded, he just as soon give me the boat back.
So now i am suppose to give him his money back; possibly put a new bottom on the boat; pay another 118.43 to ebay, I'm still thinkin this aint right.

What do ya think he ran over?

Our entire economic system is built on the theory of Caveat Emptor - Let The Buyer Beware. From what I read here, you owe him only condolences that he sunk his new boat. His neglegence or inexperience is not your responsibility.

Call the bank and talk to them in person and verify the checks cleared.

If he cancels them then hes in trouble.

Sounds like he has an attitude. You owe him nothing. You didnt sink the boat he did.

I still say its HIS boat. Period, end of story.

Yup, if the bank tells you the checks have cleared then as far as I'm concerned the man is a boat owner.
Stop being nice. Like Scotty said, you didn't sink the boat .... he did.

30 Days money back guarantee??? Well, I know you won't do that again. However, the boat must have been as you described or he wouldn't have given you a check. So, it looks like your obligation is over. He now owns a boat. I just worry about the check being canceled. Even though it clears your bank it doesn't mean it made it back and cleared his bank. I hope it has.
Let's all be carefull about checks since there are so many scams out there now. Everytime I sell something on E-bay I get the scams that want me log on to my Pay Pal or Ebay account to check for fraud. They are just trying to get my password information. I like the guys that want to send me $8,000 for a $200 item and I give them back the difference by wire transfer. I always accept the check just to get them to pay for the Fed-Ex delivery. They send certified checks that look really good. I have several checks if anyone wants to take one in exchange for say a dollar in cash. Get cash or at least a postal money order. If it isn't cash then don't deliver anything until the check has cleared plus one extra month.
If you get scammed the police will make a report but don't expect anything else. 33 years on the Police force, so, trust me, the Police, FBI, Secret Service, Postal inspectors etc. will not help you. They'll just make a report. Protect yourself.
 
I would imagine something went wrong with the automatic bilge pump that was to work fine and didn't. If your word is your bond give the money back other wise keep the money. Cummins georgia ,I met to ole georgia boys from cummins georgia out side the restaurant on sunday morning .They were looking at my boat and ask me if how much I would sell the boat for and I told them that it weren't for sell and that if I did sell it I'd have ta get a deevorce cause the wife love'sd the boat more then me. They than told me about buying this boat on ebay for 5200.00 and how it sank at the dock .
He did say that the ole boy that sold it to them said that he would gauranty it .I told them that it was unusual for some one to guaranty a sell like that but since they had one I would get my money back. These ole boys were between the ages of 60 and 70 and it appeared that they had never been around an airboat before.I kinda felt sorry for them myself. Don't know if these too charactors are your men though.
 
Stan, you've thought this through pretty well. You're right.
This time they deserve their money back, but no warranty the next time.

Thanks for seein what I agree is the right thing to do in this case.
 
Just as I sold a used Mercedes on Sat night to a woman and the vehicle did not make it 15 miles before the Tranny shot craps. When I traded for this car we drove it and appraised it and nothing showed up. Two days later it will not go. It is not her fault and not mine either. We did sell her the car thinking it was in fine shape, mechanically, and never dreamed it would have a problem. In Arkansas, there is a 3 day time period for someone to change their mind, BUT I have to solicite their business at a neutral place for this law to be effective, we did not. So the law says to her "Sorry that you bought a broke down car", but being 4th genreation owning the same store I gave her her $ back this morning. There truely could be something wrong that you did not know about that just surfaced. It can happen.
