POLK COUNTY LAWS FOR AIRBOATS: 8/21/2006

Airboat shall mean any boat, sled, sea skiff, or swamp boat pushed or pulled or propelled by air power generated by an engine of more than twenty-five (25) horsepower.

(l) No person shall operate an airboat between the hours of 10:00 p.m. and 7:00 a.m. Sunday through Thursday and 12:00 midnight and 6:00 a.m. Friday and Saturday, Memorial Day, Independence Day, and Labor Day. Nothing herein shall prohibit the operation of a properly operated airboat by an individual possessing an alligator trapping license as required by Section 372.6673, Florida Statutes, and possessing a harvest permit issued by the Florida Game and Freshwater Fish Commission pursuant to Rule 39-25.042, Florida Administrative Code. This exemption shall only apply during the harvest season as established by the Florida Game and Freshwater Fish Commission.
Airboats may be operated during the hours of 4:00 a.m. and 7:00 a.m. during authorized waterfowl hunting season.
Exempt from the provisions of this section are Lakes Arbuckle and Hatchineha and immediately adjacent waterways and the Kissimmee River Oxbow located in Polk County between Lakes Kissimmee and Hatchineha and described in paragraph (k) of this section.
(m) No person shall operate an airboat above an idle speed within five hundred (500) feet of a residence. This section shall not apply to the use of airboats by duly licensed and authorized persons engaged in the commercial eradication or control of aquatic weeds.
The distance setback from residences in this subsection shall not apply during the hours of 8:00 a.m. and 5:00 p.m. Monday through Saturday to the use of airboats by commercial operators of airboat tours or rides holding a valid occupational license for such purposes as of March 5, 1996, for purposes of gaining ingress and egress to their base of operations or to residences constructed on Lake Hamilton after the effective date of this ordinance [Ordinance No. 96-14].

(n) Vessels operated on waters in the unincorporated area of the county:
(1) Exhaust regulations. The exhaust of every internal combustion engine on any vessel operated on the waters of unincorporated Polk County shall be effectively muffled so as to muffle the noise of the exhaust in a reasonable manner. Furthermore, the exhaust of every airboat shall be effectively muffled by automotive or aircraft style equipment. The use of cutouts is prohibited, except for vessels competing in a regatta or official boat race, and for such vessels while on trial runs.

(o) Exemption. Nothing in this section shall apply to the use of an airboat by duly authorized agents of the state, county, or federal government in the performance of their official duties.

Sec. 4.2-46. Use and operation--Prohibited.
(a) No person or legal entity, through its officers, agents or employees, shall start, operate within or upon, launch from, dock at, anchor to or from the premises of county park facilities at Lake Rosalie or Lake Pierce.
(b) No person or legal entity through its officers, agents or employees, shall operate within or upon four hundred (400) feet of the established mean high water or ordinary high water line, whichever is greater, of the shoreline, of the county park facilities at Lakes Rosalie and Pierce.
(c) The board of county commissioners may, by resolution, create temporary exceptions to the prohibitions contained in this section in order to accommodate special events that serve a public purpose. Such temporary exceptions may be conditioned. The sheriff's department shall be notified of any such exception.

Sec. 4.2-47. Same--Exceptions.
The provisions of this article shall not apply to airboats operated by any law enforcement officer or government employee or agent, in their official capacity as an officer, employee or agent, licensed professionals or agents of licensed professionals conducting studies, tests, observations, aquatic plant management or related activities, or an actual emergency as determined by the county's director of parks and recreation or his designee.
 
Thanks for finding and posting these cntry. Gatorstick did the same not too long ago, and it's just another value that this site brings to our sport.

Suggestion: Maybe this is not worth the effort, but could a summary of all the laws be made here? I hate to suggest the creation of yet another forum, but it sure would be nice to have ALL the laws and ordinances posted in one place - where discussion & first hand experience in living with the laws can be heard.

More and more of us are travelling to other counties for short outings. It sure is nice to read up on the local rules so we can be good boaters.

I know I've searched the state and some county sites for this type of info and it's like reading chinese sometimes!!!! The actual info you want seems to be buried in the most illogical place.

Updating it and keeping it current would be a slight chore... but I'll help in any way I can if this seems to be a good idea.

I learned some things reading the laws/ords posted above.

BTW, thanks cntry for giving it a good title - that'll make it easier to find using the search feature.

I'll be on the lake this coming Labor day weekend. Can someone tell me when I can be on my boat and when I can't? :roll:

Lake Hatchineha, Gardners Marsh, Lake Kissimmee and Lake Cypress and the connecting marshes are in Osceola County.

Why did I have to go to Polk county to pay my fine for tresspassing on the outside of lake Kissimmee's edge? I mean what's wrong with being a mile from any water right. :wink:
 
Naw BD we didnt set you up really.

Curfew ??? I sure hope not . but you never say never the good news is osceola county so far doesnt have any regs for airboats and they build dry load ramps so it looks like we are good there
 
A little sales plug - but Airboating Magazine is working on publishing a list by county of airboat ordinances (curfews, access restrictions). Not sure if this issue will have all counties or not but most of the major ones - it's being validated now with a couple different groups. This issue will be just Florida but research team already has other states in their schedule (my wife is a task master - eerrr I meant project manager so she has all that on a big list).

It will be in kinda small print with lots of the legal garbage stripped out so will have the bare bones stuff in it (it's all about the print space I've been told).
 
Thanks hawk. That's great that it'll be in print like that. It's just my guess, but you may end up re-printing that stuff from time to time so everyone can see it.

And thanks for stripping out all the legal mumbo-jumbo. Dang, sometimes those dumb laws are so hard to understand! What ever happened to "you can do this but not that"????

Thanks for this post. I was actually looking for the Polk County regs, as I drew Lake Pierce for gator hunting this year and heard you could not operate an airboat there after 10. If I read this correctly, the airboat can be operated after 10 if you are properly licensed to hunt gators. If I have read this wrong, somebody please correct me so I don't get busted by the man.
 
Sounds good to me. AS I understand it you are making a correct assumption.

One word that probably has already gone thru your mind: Take it easy if you are out there late and be courteous.

You will have an opportunity to show everyone on that lake that airboats are not as bad as they think, or maybe on the other hand, they are justified in outlawing them on their lake.
